Please read these terms carefully. They explain your rights and responsibilities when you use X24Play.
Agreement to these terms
These Terms of Service (“Terms”) apply to the website x24play.com and all X24Play software and services, including the X24 TV apps (Xlite, Xpro and XPromax), the X24 Hub, the X24 web app and X24cloud (the “Services”). By installing, activating or using the Services, you agree to these Terms on behalf of yourself and the business you represent (“you”, the “Customer”).
Accounts and licences
- Each licence is issued to one customer for a set period (its expiry date) and a maximum number of screens.
- Licences are personal to you. You may not sell, rent, share, sub-license or transfer them without our written approval.
- You are responsible for your logins, passwords, activation files and devices, and for everything done with them.
- You must give us accurate information and keep it up to date.
Licence types and use for other brands
Standard licences (Xlite, Xpro and XPromax, unless your written quote says otherwise) are for showing your own business’s content: your own products, services, offers, menus and brand.
Showing advertising or promotions for other brands, businesses or organisations requires a Commercial Advertising licence. This includes selling ad airtime, running third-party ads in public places, or showing other companies’ promotions whether paid or free.
If we find that a standard licence is being used to promote other brands, we may suspend or terminate that licence immediately, without refund. We may also require you to upgrade to the correct licence and pay the difference before the service is restored.
Your content and your responsibility
X24Play provides technology only. You alone decide what plays on your screens. We do not create, review, approve or monitor the media you upload or schedule.
- X24Play is not responsible for any media played by the Customer, including its accuracy, legality, ownership, suitability for the audience, or compliance with advertising and consumer laws.
- You must own or have permission for everything you display: videos, images, music, fonts, logos, trademarks and people’s likenesses, including any public-performance or music licences.
- You must follow all laws and rules that apply to your screens and ads, including advertising standards, consumer protection, price display, health claims, restricted products (such as alcohol or tobacco) and any permits needed for public displays.
- You agree to cover (indemnify) X24Play against claims, fines and costs caused by your content or your use of the Services.
- If we are told about, or find, content that appears unlawful or breaks these Terms, we may disable it or suspend the affected screens or account.
Prohibited content and use
You must not use the Services to display or distribute content that:
- is illegal, fraudulent, deceptive or misleading;
- infringes copyright, trademarks or other rights;
- is sexually explicit, hateful, violent, threatening or harassing, or is unsuitable for the public place where the screen is located;
- contains malware or links to harmful websites.
You must not:
- copy, modify, decompile or reverse-engineer the software;
- bypass licence checks, screen limits, expiry or watermarks;
- resell the Services without a written reseller agreement;
- interfere with the security or operation of the Services, or use them to build a competing product.
Fees, renewals and refunds
- Prices are given in your quote and are payable in advance unless agreed otherwise in writing.
- A licence ends on its expiry date unless it is renewed. After expiry, some or all features may stop working.
- Fees are non-refundable except where the law requires otherwise or where we agree in writing.
- You are responsible for any taxes that apply.
Hardware, installation and safety
You are responsible for your TVs and devices, mounting, wiring, networks and the safe installation of screens in your premises. Please check device compatibility with us before you buy hardware.
Availability and offline playback
We work to keep the Services reliable, but we do not guarantee they will be uninterrupted or error-free. Features such as offline playback (for example, XPromax playing for up to 3 days without internet) depend on device storage and setup, and are not a guarantee. We may carry out maintenance and release updates that change or improve features.
Suspension and termination
We may suspend or end your access, with or without notice, if you break these Terms, do not pay, misuse a licence (including using a standard licence to promote other brands), display prohibited content, or create a security or legal risk. You may stop using the Services at any time. Sections that by their nature should survive termination (such as content responsibility, liability limits and indemnity) will continue to apply.
Our software and branding
The Services, software, designs and X24Play brand belong to X24Play and its licensors. We grant you a limited, non-exclusive, non-transferable right to use them during your licence period under these Terms. Depending on your plan, a small “www.x24play.com” mark may appear on screens. It may only be turned off through the settings we provide. If you send us feedback, we may use it freely.
Reviews and customer logos
If you send us a review or permit us to show your logo, you allow X24Play to display it on our website and marketing. You can ask us to remove it at any time.
Disclaimers
To the extent the law allows, the Services are provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, uninterrupted operation, or results such as sales or advertising revenue.
Limitation of liability
To the extent the law allows, X24Play is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, advertising income, data or goodwill. X24Play’s total liability for any claim is limited to the fees you paid for the affected Services in the 12 months before the claim.
Cloud account and third-party services
XPromax and X24cloud work with the cloud account you connect (your own Google account). Your use of that account is also subject to its provider’s terms. You are responsible for that account, its security and its storage space. The Services also depend on your TVs, Android TV devices, networks, power and internet providers. We are not responsible for outages or changes caused by third-party services.
How we handle this data is explained in our Privacy Policy.
Changes to these terms
We may update these Terms from time to time. We will post the new version here with a new “Last updated” date and notify customers of important changes. Continuing to use the Services after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the place where X24Play is registered, and disputes will be handled by the courts of that place, unless your written agreement with us says otherwise.
